1. Definition of Terms

  • Donation — Voluntary financial contributions.
  • Community Membership — Paid and free monthly subscribers.
  • Collector of Donations — The owner and legal custodian of the platform, the Non-Entrepreneurial (Non-Commercial) Legal Person NNLE "Hippo Velo Georgia".
  • User — Any individual who uses the website.
  • Platform — The websitewww.nickphaliani.com, through which users make donations for the bike trail and register for community membership.
  • Organizer / Project Developer — The legal entity responsible for project implementation and donation collection.

2. Acceptance of Terms

By using this website, you agree to these Terms of Service. If you do not agree with any part of these terms, please do not use the Platform.

3. Charitable Purpose / Non-Economic Activity

The User acknowledges and agrees that the construction of the mountain bike trail is carried out exclusively for charitable and non-economic purposes. Funds paid via donations and community membership registrations are dedicated to the construction of the bike trail, the execution of all necessary activities to ensure proper and high-quality implementation of the project, as well as supporting the beneficiaries or goals specified on the site. Transaction fees (if applicable) do not constitute a charitable donation.

4. Donations

  • Donations are voluntary contributions made to support the bike trail project.
  • Donations are non-refundable, except in cases provided for by law.
  • We make every effort to allocate funds strictly for the purposes described on the site.
  • Progress indicators are updated in good faith and may not always reflect total collected funds in real-time.

5. Membership, Subscription Cancellation, and Refund Policy

  • Nature of Membership: Community membership constitutes a recurring monthly donation, which the User confirms upon registering on the website.
  • Perks & Bonuses: Perks and bonuses are provided by supporting partner companies of the bike trail and are subject to their respective terms and conditions.
  • Paid Subscription Cancellation Rules:
    • Members have the right to cancel their paid monthly recurring donation at any time.
    • Subscription cancellation can be performed directly through the community section of the Platform by clicking the "Cancel Subscription" button, or by notifying the Organizer via official electronic communication channels.
    • Upon the completion of the current billing cycle, the User will no longer be charged for the paid membership, and their account will automatically transition to the free community membership tier.
  • Refund Policy: Paid membership fees are eligible for a refund if a formal request is submitted by the member. Refunds will be processed within a reasonable timeframe using the original payment method, unless applicable legislation provides otherwise.
  • Refund Request Procedure: To request a refund, Users should contact the Organizer via email at Hippovelogeorgia@gmail.com or through official social media communication channels.

6. Access to the Bike Trail

The Niko Phaliani Bike Trail is open to everyone completely free of charge. Membership and donations support the ongoing maintenance and development of the trail, but do not grant exclusive access. All visitors and riders use the bike trail entirely at their own risk.

7. Content

All content available on this site is owned by or licensed to us. You are welcome to share links to our web pages; however, you may not reproduce, distribute, or copy our content without prior written permission.

8. Limitation of Liability

We provide this website and the bike trail infrastructure on an "AS IS" and "AS AVAILABLE" basis, without guarantees of any kind. Mountain biking inherently involves certain risks. We are not liable for any injuries, losses, or damages incurred while using the bike trail.

9. Personal Data Protection

The User confirms that they have read and understood the Privacy Policy and consent to the processing of their personal data in accordance with applicable regulations.

10. Amendments & Modifications

The Project Developer reserves the right to amend these terms at any time by providing users with reasonable prior notice.

11. Governing Law & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of Georgia. Any disputes arising hereunder shall first be resolved through good-faith negotiation. If an agreement cannot be reached, the dispute shall be submitted to the Tbilisi City Court or the relevant administrative authority.
